บ้านเมืองไม่ใช่ของเรา

หลังจากที่พากเำพียรเรียนเรื่องกฎหมายมหาชนมาเป็นเวลาหลายปี ความเชื่อที่สังสมในตัวว่านิติรัฐคือเป้าหมายที่ประเทศไทยจะต้องไปให้ถึง หลังจากเรียนจบ รธน.2540 ก็ถูกคณะรัฐประหารฉีกทิ้ง องค์กรการเมืองถูกเปลี่ยนแปลง องค์กรอิสระที่ถูกสงสัยว่าไม่เป็นกลาง ก็ไม่เป็นกลางจริงๆ (วัดได้จากผู้ที่เข้าไปมีส่วนร่วม)

มาวันนี้ ทำเนียบฯ ถูกยึด สนามบินถูกยึด สภาพไม่ต่างกับถูกปิดประเทศโดยคนกลุ่มหนึ่งซึ่งอ้างสิทธิตามรธน.แต่ไม่ได้ใยดีต่อสาระของ รธน.เลย

รัฐบาลก็ไม่ต่างกับคนเป็นง่อย ทำอะไรไม่ได้แม้แต่จะรักษาความสงบเรียบร้อย ทหารก็ไม่ได้ทำหน้าที่ของตนเอง กลับกลายเป็นพลังการต่อรองทางการเมืองเสียนี้ แล้วที่พร่ำมาตลอดว่าทหารในยุคนี้เป็นทหารอาชีพ หมายความว่าอย่างไร

นักวิชาการ อาจารย์มหาวิทยาลัยบางกลุ่มก็ออกมาเรียกร้องให้ปฏิวัติ ทั้งๆที่รู้อยู่แก่ใจว่า มันเท่ากับเป็นการเปิดประตูให้โจรปล้นบ้าน ทั้งหมดนี้มันหมายความว่าอย่างไร ?? สงสัยบ้านเมืองนี้จะไม่ใช่ของเราอย่างที่เขาเอาไปตั้งเป็นชื่อรายการในเว็ปประชาไท

ผมคิดอยู่ว่า ประเทศไทยวันนี้กำลังมีลักษณะใกล้กับ Failed state
ในวิกี้พีเดีย อธิบายไว้ว่า "A state could be said to "succeed" if it maintains, in the words of Max Weber, a monopoly on the legitimate use of physical force within its borders. When this is broken (e.g., through the dominant presence of warlords, paramilitary groups, or terrorism), Weber clearly explains that only the state has the means of production necessary for physical violence (politics as vocation). This means that the state does not require legitimacy for achieving monopoly on the means of violence (de facto) but will need one if it needs to use it (de jure)."

สำหรับตัวชี้วัดทางการเมืองของรัฐที่ล้มเหลวได้แก่
1. Criminalization and/or delegitimisation of the state
2. Progressive deterioration of public services
3.Widespread violation of human rights
4.Security apparatus as ‘state within a state
5.Rise of factionalised elites
6.Intervention of other states or external factors

แล้วลองพิจารณากับเหตุการณ์ที่เกิดขึ้นในปัจจุบันนะครับ ผมว่ามันใกล้เข้ามาทุกทีแล้วนะครับ

ในเอเชียตะวันออกนี้มีสองประเทศเท่านั้นครับที่อยู่ลักษณะเช่นว่านี้ คือเกาหลีเหนือกับพม่า

สิ่งที่หวังไว้ลึกๆคือ ประเทศไทยคงไม่ตกอยู่ในสภาพเช่นเดียวกันครับ

พรุ่งนี้จะมีการตัดสินคดียุบพรรคร่วมรัฐบาลสามพรรค ท่าทางจะรอดยาก เราก็ได้แต่ติดตามดูความเปลี่ยนแปลงละครับเพราะนี้เป็นบ้านเมือง(ไม่ใช่)ของเรา

Return Home--- but where is my home? (-.-!!)

Finally I finished a master degree from Malaysia. A year away from home while so many things happened when I was away. The first week after I arrived home, I didn't feel like it was the Bangkok I knew. Politic here is still under ambiguity. I was shocked that many legal experts said things in the opposite ways from what they used to believe. I feel like I was betrayed; as the politicians, both elected and wana be, cannot explain what democracy is. I was really --- off when I read more about PDA. Where is the law enforcement? What's the good of having a brilliant constitution without anyone understand it and willing to implement it?

For me, I still believe that democracy has got only one style. There is no Thai style or western style. From what I've learned, the 1997 constitution is still the best one of its kind; and still usable. I don't know what is happening in this beloved country. People easily misunderstand even the crucial democratic concept. Why it is so? If anybody can clear my mind, please let me know. Sigh.. I thought Thailand has got the highest democratic value in Southeast Asia, though there were many coup in its history.

Muslim and Regional Integration

What I have been studying in class this week is about Islam and globalisation. There are so many lines that separate Muslim thought from the Modern world; I would suggest the modern world is based on the European values which developed from Christianity. However, the point I am making is while the contemporary societies are able to adapt themselves to globalisation, many Islamic societies found difficulty. It may be because of the religion's charactoristic which has a very strong social structure. For now, I am a unknowledgeable student in this field. I am really wonder whether it is true that Islamic charactor does not support multi-culturalism and regional integration. For the sake of ASEAN which has its muslim members as the majority, I do really want to be able to answer such a religion matter ( which many people do not wish to talk about).

What's a surprise for the recently M'sia election result. Before the election, many Malaysians complained to me that their politic was really really boring. The Barison National(BN) always won elections and ruled the country. Do you know M'sia has only 4 prime minister during 50 years of independent! Only Dr. Mahathir himself ruled this Fed around 20 years. Wow.... a surprise for Thais who always change their PM every 2-3 years; either throught election or coup d'etat lah..

The environment before the GE was quite boring and quiet, from my sight as a Thai, rather than actively participated by the people. I am not quite sure why but many people said that they were not interested in the politic. Some even did not go to the ballocts because they thought that it could not change anything. BN still won and the oppositions would depressed as usual.
According to the last election, the opposition parties won only in norther states: Kalantan Traganu where the majority are muslims. However, the recent election turned out to be a disaster for BN, especiallly for the UMNO. They lost almost all of the northern states; Kedah, Penang, Kalantan, Tranganu. Even in Salangor which is considered as a middle part, KL is inside Salangor, was lost to the opposition. What's a mass for BN lah.

Nevertheless, I think that it is better for M'sia to have a stronger opposition. Once they was able to keep opps's mouths shut, people lost their freedom of expression too. From now I think that M'sia politic is so interesting lah kap....:)
